Men Cell Delhi: File तो कर दी… लेकिन Registry की objection कौन देख रहा है?
बस, यहीं से कभी-कभी असली problem शुरू होती है।
12 March 2026 को Delhi High Court के सामने एक matter में written statement prescribed period के भीतर file हुई थी, लेकिन Registry ने objections लगा दीं—process fee, affidavit, vakalatnama और annexures से जुड़ी deficiencies सहित। उन objections को बार-बार हटाने के opportunities मिले, लेकिन compliance नहीं हुई। आखिरकार written statement का right close हो गया और बाद की challenge भी unsuccessful रही.
अब जरा Focus कीजिए।
Court case में सिर्फ “file कर दिया” काफी नहीं होता। Filing properly complete हुई या नहीं? Registry ने objection लगाई या नहीं? Re-filing हुई या नहीं? कोई limitation चल रही है? कोई application चाहिए? अगली तारीख तक कौन-सा defect हटाना है?
ये छोटी administrative बातें दिखती हैं, लेकिन कभी-कभी यही छोटी चीज case की बड़ी problem बन जाती है।
अब Emotion सोचिए।
आप husband हैं। Wife के साथ matrimonial dispute चल रहा है। शायद CAW Cell Delhi में complaint है, police inquiry चल रही है, property dispute अलग है और office में किसी को पूरी बात बताना भी नहीं चाहते। आपने advocate को documents दे दिए और मान लिया—“अब मेरा काम हो गया।”
फिर महीनों बाद पता चले कि filing objection में पड़ी थी।
और फिर मन में वही सवाल आता है—“अगर मुझे पहले बताया होता तो?”
यहीं Agitation जरूरी है।
Delhi High Court ने इस matter में यह भी स्पष्ट किया कि litigant को अपने pending proceedings के प्रति vigilant रहना चाहिए; केवल advocate को दोष देकर prolonged inaction को हमेशा excuse नहीं किया जा सकता.
इसका मतलब यह नहीं कि advocate की negligence कभी matter नहीं करती। इसका मतलब यह है कि अपना case पूरी तरह किसी और की memory और diary पर छोड़ देना भी risky है।
Men Cell Delhi search करने वाला husband अक्सर पूछता है, “मेरी wife के खिलाफ complaint का क्या होगा?” लेकिन एक दूसरा सवाल भी उतना ही important है—“मेरे case में अब तक वास्तव में file क्या हुआ है?”

आपकी career प्रभावित हो सकती है। आपकी finances litigation में फंस सकती हैं। आपकी reputation पर allegations का असर पड़ सकता है। आपका relationship टूट भी सकता है या सही intervention से संभल भी सकता है। इसलिए timely review सिर्फ “legal luxury” नहीं है।

फिर strategy तय कीजिए।
