COMPLAINT AGSINST WIFE IN MEN CELL | PURUSH AAYOG | DELHI : MISTAKES TO AVOID

CAW CELL DELHI | MenCell.Org Delhi: पहले Revision, फिर High Court? यहाँ गलती महंगी पड़ सकती है

What happens when a CAW Cell Delhi complaint becomes an FIR, charges are framed, and the accused has already challenged that charge order once?

A recent Delhi High Court judgment shows why case strategy should be planned before choosing the next legal remedy.

In Rajesh Kumar & Anr. v. State, decided on 2 September 2026, the wife had first approached the Crime Against Women (CAW) Cell in April 2017. The complaint eventually resulted in FIR No. 369/2017 at PS K.N. Katju Marg under Sections 498A/406/34 IPC and Section 4 of the Dowry Prohibition Act.

The matter reached the stage of charge.

The accused persons challenged the charge order before the Revisional Court. That revision was partly successful: two step-relatives were discharged, while the husband continued under Section 498A and the step-mother-in-law continued under Section 406 concerning the specific allegation of jewellery/stridhan.

Then came the next move.

The remaining accused approached the Delhi High Court under Section 482 CrPC, seeking to get the surviving proceedings quashed.

But यहाँ एक important procedural point सामने आया.

The High Court explained that Section 482 is a wide inherent power, but it is not ordinarily a route for circumventing the restriction against a second revision after the accused has already invoked revisional jurisdiction. Exceptional cases involving an extraordinary situation or abuse of process can still justify inherent intervention, but judicial restraint applies.

The Court ultimately declined to quash the surviving proceedings. It held that deciding questions such as the truth of the cruelty allegations, the alleged entrustment of jewellery, demand and refusal, and the evidentiary value of the competing versions would require appreciation of evidence at trial.

For a husband dealing with a matrimonial complaint, CAW Cell Delhi, CAW Cell Nanakpura, Crime (Women) Cell or a Delhi NCR matrimonial FIR, this is a practical warning:

हर adverse order का जवाब तुरंत अगली petition नहीं होता.

First understand what remedy has already been used, what exactly the earlier court decided, what remains open, and whether the proposed High Court petition is legally maintainable in that procedural situation.

A hurried second move can create a much bigger problem if the legal route itself becomes the issue.

And remember: a CAW Cell complaint, FIR, charge order and trial are different procedural stages. The strategy at one stage cannot automatically be copied into the next.

If you are already facing proceedings in Delhi or Delhi NCR, don't wait until multiple orders have accumulated before getting the entire procedural history examined.

Delay in understanding the record can make the next legal decision much harder.

Case-specific caution: The Delhi High Court's decision was based on the procedural history and allegations in that particular case. It does not mean that every accused person who has previously filed a revision is automatically barred from invoking inherent jurisdiction. The maintainability and merits of any further remedy depend upon the exact orders, stage of proceedings and facts of the individual case.
